Terms of Service

Welcome to Let's Offroad Together ("we," "our," or "us"). These Terms of Service ("Terms") govern your access to and use of the Let's Offroad Together mobile application and website (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility

You must be at least 13 years of age to use the Service. By using the Service, you represent and warrant that you meet this age requirement. If you are under 18, you represent that you have your parent or guardian's permission to use the Service.

Account Registration & Responsibilities

To access certain features of the Service, you must create an account using a valid email address or a supported sign-in provider (Apple or Google). You are responsible for:

  • Maintaining the confidentiality of your account credentials.
  • All activity that occurs under your account.
  • Providing accurate and complete information in your profile.
  • Notifying us promptly if you suspect unauthorized access to your account.

We reserve the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

Subscriptions & Payments

The Service offers a free tier and optional paid subscription tiers (Premium, Trail Leader, and Club Pro) that unlock additional features. By subscribing, you agree to the following:

  • Auto-Renewal — Subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date.
  • Billing — All payments are processed through Apple's App Store (via In-App Purchase). Pricing is displayed in the app before purchase and may vary by region.
  • Cancellation — You may cancel your subscription at any time through your device's subscription settings (Settings > Apple ID > Subscriptions on iOS). Upon cancellation, you retain access to paid features until the end of your current billing period.
  • Free Trials — If offered, a free trial converts to a paid subscription at the end of the trial period unless cancelled beforehand.
  • Refunds — Refunds are handled by Apple in accordance with their refund policies. We do not process refunds directly.

User Content

You may create, upload, and share content through the Service, including drive descriptions, event details, club information, messages, photos, trip reports, and reviews ("User Content"). You retain ownership of your User Content, but by posting it through the Service, you grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your User Content solely for the purpose of operating and improving the Service.

You agree not to post User Content that:

  • Is unlawful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
  • Infringes on the intellectual property rights of any third party.
  • Contains viruses, malware, or other harmful code.
  • Promotes illegal activities or violates any applicable law or regulation.
  • Is spam, commercial solicitation, or misleading content.

We reserve the right to remove User Content that violates these Terms and to suspend or terminate accounts that repeatedly violate our content policies.

Intellectual Property

The Service, including its design, features, code, graphics, logos, and trademarks, is owned by Let's Offroad Together and is protected by applicable intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of the Service without our prior written consent.

Location Services & Safety

The Service uses location data to provide trail maps, drive routes, meeting points, and convoy features. You acknowledge and agree that:

  • Off-road activities carry inherent risks, including but not limited to vehicle damage, personal injury, and environmental hazards. You participate in all off-road activities at your own risk.
  • The Service is not a safety device. Trail information, maps, difficulty ratings, and route data are provided for informational purposes only and may not be accurate or up-to-date.
  • You are solely responsible for assessing trail conditions, your vehicle's capabilities, and your own experience level before participating in any drive or event.
  • Emergency contact information shared within the app is a convenience feature and does not replace calling emergency services (911 or local equivalents).

Third-Party Services

The Service integrates with third-party providers including Firebase (Google), Google Maps, RevenueCat, Google AdMob, and Apple services. Your use of these third-party services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.

AI-Generated Content

The Service offers optional AI-powered features to help you generate descriptions for drives, events, and clubs. AI-generated content is provided as a suggestion and may not be accurate. You are responsible for reviewing and editing any AI-generated content before publishing it. We do not guarantee the accuracy, completeness, or appropriateness of AI-generated content.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY DEFECTS WILL BE CORRECTED.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LET'S OFFROAD TOGETHER AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify, defend, and hold harmless Let's Offroad Together and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Service, your User Content, or your violation of these Terms.

Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. You may delete your account at any time from your profile settings. Upon termination, your right to use the Service ceases immediately, and any active subscriptions will not be refunded for the remaining billing period.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in California.

Changes to These Terms

We may update these Terms from time to time. When we make changes, we will notify you by updating the effective date at the top of this page and, where appropriate, through an in-app notification or app update. Your continued use of the Service after any changes constitutes acceptance of the updated Terms.
